It’s only “high” for liberals who find it difficult to count past 10. To the rest of us, we realize 30 round magazines are “standard”. But yes, legislation is underway to ban sales and possession of any “standard” magazines that can hold greater than 10 cartridges.
Introduced by Sen Schumer (D. NY):
The amendment was sponsored by Democratic Sens. Frank Lautenberg (N.J.), Barbara Boxer (Calif.), Jack Reed (R.I.), Bob Menendez (N.J.), Kirsten Gillibrand (N.Y.), Schumer and Dianne Feinstein (Calif.). S.A. 2575 would make it illegal to transfer or possess large capacity feeding devices such as gun magazines, belts, feed stripes and drums of more than 10 rounds of ammunition with the exception of .22 caliber rim fire ammunition. All freedom loving Americans will no doubt find this absurd. It’s up to you to contact your senators today and make sure they oppose this and support out liberties.
And if you support the ban due to the Colorado murders, you must know that the murderer’s rifle jammed on him, and most of the shooting was done with a simple Remington 870 shotgun. He was free to kill for 20 minutes, probably due to the theatre’s flawed “No (legal) Guns” policy.

I definately think a thirty round magazine is nowhere near large in any case, but anything larger than thirty would simply be overkill. Ten seems absurd, but who needs more then thirty in a semi-automatic gun? Nobody. Hope they change it up a bit and find a better way to solve shootings.
Mark – “needing” a 30+ magazine and being able to own one is not what the government should be able to tell us to do.
I don’t “need” a sports car that can go faster than 80mph, but if I want one, by George I should be able to buy one. Then, I simply obey the laws and won’t speed as well.
Laws are in place to prevent murder, how about we obey those laws instead of imposing freedom restrictions on the entire populace?
Well said Dustin. Can I borrow the sports car analogy?
Law’s were made for the reasonable person, which is who will be affected. I deal with the criminals on a daily basis. They don’t follow the law as is, and they could care less about the people that do. We truly make things easier for the criminal with stringent firearm laws.
Thanks Colin! And borrow away!
It wasn’t a law. It was a restriction the theater had in place. I’d assume legal repercussions would be from the theater pressing charges personally to the “shooter” that could have taken him out
Are you from CO and know how those laws work? Because in Texas, a “no guns” sign carries no merit unless you post the exact 30.06 wording. However in some states, “No Guns” has the weight of the law.
OHIOoan here. I follow your blog cause I had a blast watching you on Top Shot. I believe we have the same law here, at least i’m 90% sure as of five years ago when I obtained my CCW.
A refresher couldn’t hurt though.
Dustin, what would the repercussions be if a legal CCW holder had been carrying (illegally in this theatre) and had stopped this James Holmes? Now I know that he was wearing body armor, I am merely using him as an example.
Just curious if the CCW holder would be forgiven for breaking one tiny stupid law to save the lives of many.
I realize that companies have the right to post these “No (legal) Guns” signs, and that as a CCW holder you should take your business elsewhere.
Mark I’m not a lawyer, so I can’t answer for the legal repercussions. But most likely, he would have cut this cowardly murder’s killing spree short. The idiot didn’t want to die, wasn’t committing suicide, he would have tucked tail and ran or been put down if someone else took action. The question is – would you rather lie down and die or defend yourself against evil?
I completely agree with you Dustin and I couldn’t have said it better myself.
I am curious of the repercussions. I will have to further investigate this.
I don’t think there would be any legal repercussions. Carrying a firearm in public is allowed on CO law so the worst the movie theater could have done was ban them from the theater.
The people in the theater were fortunate that he had a very high capacity drum magazine. Those tend to jam easily. The killer’s did just that. I will write my Senators and stock up on “normal” sized 30/20 round magazines. Thank you for the Senator links! I have already written them.
Exactly Marty. And thanks for supporting!
Do you have links for us NYers who want to email our senators?
