Texas CHL and 30.06 – Where can I carry?

When you see the numbers 30.06 and smile you might be a gun guy.

If you see 30.06 posted on a business and you cringe you are a Texas gun guy.

30.06 relates to the Section of Penal Code where the law outlines “trespass by a holder of license to carry concealed handgun.”  Here you will find the complete lists of TX CHL laws, but in general, if a property owner post the below text in in contrasting colors with block letters at least one inch in height in a conspicuous manner clearly visible to the public in order to declare a legal “Gun Free Zone” and to carry past it is Class A misdemeanor.

PENAL CODE (TRESPASS BY HOLDER OF A LICENSE TO CARRY A CONCEALED HANDGUN)
A PERSON LICENSED UNDER SUBCHAPTER H, CHAPTER 411, GOVERNMENT CODE (CONCEALED HANDGUN LAW), MAY NOT ENTER THIS
PROPERTY WITH A CONCEALED HANDGUN.”

“CONFORME A LA SECCIÓN 30.06
DEL CÔDIGO PENAL (TRASPASAR PORTANDO ARMAS DE FUEGO) PERSONAS CON LICENCIA BAJO DEL SUB-CAPITULO H, CAPITULO 411, CODIGO DE GOBIERNO (LEY DE PORTAR ARMAS), NO DEBEN ENTRAR A ESTA PROPIEDAD PORTANDO UN ARMA DE FUEGO.”

So per those requirements, a sloppy sign like this one posted at Lufkin Lanes is invalid due to it not having 1″ letters nor being in Spanish:

Nor does this sign have any weight of law from Church’s Chicken in Jasper.  Although it will ensure that you are boycotted due to your anti-American stance and insulting firearms owners as a nuisance.

Penal Code 46.03 outlines the places where weapons (including firearms, illegal knives and clubs) are ALWAYS prohibited:

• a school or educational institution
• passenger transportation vehicle of a school or educational institution
• polling places on election day or early voting
• government court or court offices
• racetracks
• secured areas of airports
• 1,000 feet of an place of an execution

Penal Code 46.035 Unlawful Carry of a Handgun by License Holder at the following locations:

• a business that earns 51% of income from alcohol sales (will have a 51% sign posted)
• high school, collegiate or professional sporting event
• correctional facility
• hospitals (must post 30.06 signage)
• amusement parks (must post 30.06 signage)
• churches, synagogue or place of worship (must post 30.06 signage)
