The Texas Parks and Wildlife Department (TPWD) is asking for public input on a proposed update to the rules governing commercial party boats — vessels that carry more than six passengers for hire on Texas inland waters. While the proposal may look bureaucratic at first glance, its real purpose is clear: improving safety, clarifying responsibility, and reducing risk for operators and the public alike.
Party boats are a popular way to enjoy fishing trips, celebrations, and group outings on lakes across Texas. But recent incidents have highlighted weaknesses in the current regulatory approach, which relies primarily on an annual inspection by department personnel. Under the proposed changes, TPWD would require an initial professional safety certification by an accredited marine surveyor or naval architect — someone trained to evaluate hull integrity, stability, and other critical safety factors — before a vessel can be licensed. After that, boats would still get annual TPWD compliance checks, plus additional professional inspections at least once every five years, or after significant modifications.

This approach reflects hard lessons learned. TPWD’s rulemaking documents recount cases where party boats operated legally but had serious stability, insurance, or documentation issues that routine checks didn’t catch. These included capsizing incidents, lapses in insurance, passengers on unsecured decks, and operators lacking required credentials. TPWD believes that a deeper initial inspection and clear standards will reduce those dangerous situations.
The proposal also updates minimum liability insurance requirements, clarifies documentation duties, and emphasizes that safety records must be carried aboard and made available to enforcement personnel when requested. These changes are intended to close loopholes that have allowed unsafe practices to continue under the current rules.
Importantly, these changes are not about fishing limits, hunting seasons, or recreational regulations — they focus squarely on commercial party boat safety and operator accountability.
